Directions on the Operation of Disc Transactions for Central Bank Interbank Funds Transfers and Settlements System

Prescribed on June 3, 1998
Amended on April 7,2003

  1. These Directions are promulgated by the Central Bank of China (hereafter refer to as "the Bank") to handle the Operation of Disc Transactions for Central Bank Interbank Funds Transfers and Settlements System (hereafter refer to as the "Operation").

  2. Where the computer equipment of an online institution breaks down or connections are interrupted resulting in the online institution's inability to immediately resume the use of the Bank Interbank Funds System for transfers of funds as provided in Direction 58 of the" Directions for the Central Bank of China to Govern Electronic Interbank Fund Transfers and Settlements", the online institution may conduct disc transactions in accordance with these Instructions.

  3. For conducting disc transactions, online institution shall produce disc records in accordance with the procedure and format set out by the Information Management Office of the Bank. Each transaction command shall include the transaction serial number, the account number of the transferor bank, the account number of the transferee bank and the amount and transaction type. "Disc Transaction Statements" shall be printed out for the transactions so recorded. The statement, duly signed by the operation director as well as the authorized signatory( as per attached format), shall be sent by dispatched personnel to the counter of the Department of Banking of the Bank, in order to carry out the transfers manually.

  4. The Operation does not accept "Forward Transactions".

  5. Fund transfers and clearing of each transaction recorded on the disc shall be conducted transaction by transaction. If the available balance in the account of the transferor bank is sufficient for the deduction of payment, such transaction shall be executed immediately. If the available balance is insufficient to cover the payment, such transaction shall be handled in accordance with the "queuing mechanism" set out in Direction 41 of the " Directions for the Central Bank of China to Govern Electronic Interbank Fund Transfers and Settlements".

  6. Personnel dispatched by an online institution to the Department of Banking of the Bank to carry out transfers in person shall wait for the processing result at the counter. If any of the following events occurs, the Department of Banking of the Bank shall not accept a request to handle the transactions and shall return the disc and statements to the said personnel on the spot:
    (1)The signatures of the Operation director and/or the authorized signatory are/is inconsistent with the chop/signature specimen kept by the Bank.
    (2)The transactions recorded on the disc are inconsistent with the "Disc Transaction Statement".
    (3)After the cutoff time of the queuing mechanism, there are insufficient funds to cover payment of any one of the transfer transactions recorded on the disc.

  7. For successfully completed disc transactions, the Department of Banking of the Bank will issue a "Post Filing Disc Transaction Statement" to the dispatched personnel.

  8. The Bank will use the "Disc Transaction Statements" delivered by the online institution to the Department of Banking of the Bank as original certificates for account auditing and producing vouchers.

  9. In addition to complying with these Directions, matters related to fund settlement, inquiries, handling of breakdowns (including clarifying responsibilities), fees, operating schedules and security controls, etc. shall be handled in accordance with the "Directions for the Central Bank of China to Govern Electronic Interbank Fund Transfers and Settlements".

    (Remarks: These Directions are made in Chinese which shall prevail in case of any discrepancy between the English and the Chinese original.)
